This GFiber Privacy Policy (this “Privacy Policy”) is meant to help you understand what data about you Google Fiber Inc., Google Fiber North America Inc. and Webpass, Inc. (collectively, “GFiber,” “we,” or “us”) collect, why we collect it, and what we do with it. This Privacy Policy applies to information we collect when you access or use our websites, mobile applications, and products and services that link to this Privacy Policy (each a “Service” and collectively, our “Services”) and when you otherwise interact with us. This is important; we hope you will take time to read it carefully. We’ve tried to keep it as simple as possible, but if you’re not familiar with terms like cookies, IP addresses, pixel tags and browsers, then read about these key terms first.Your privacy matters to us. This Privacy Policy applies to all Services. This Privacy Policy does not apply to the collection and use of information by other services offered by Google (such as Gmail or Google Search or Google Voice, which powers our GFiber Phone) – such information will be treated in accordance with the applicable Google policies and terms of service. This Privacy Policy also does not cover the information practices of other companies and organizations who advertise or use our Services, and who may use cookies, pixel tags and other technologies to serve and offer relevant ads. Our websites may contain links to websites owned by other companies. Because we have no control over the privacy practices or content of these linked sites, we recommend that you carefully review the privacy statement of each website you visit. GFiber is not responsible for the content or privacy practices of websites owned by other companies. In addition, this Privacy Policy applies only to information provided by or collected from customers and users in the United States and is not intended to describe data handling procedures for information collected by other linked websites or business partners. This Privacy Policy addresses our procedures for handling the personal information of customers in the United States who are at least 13 years old. We do not seek to collect, nor do we knowingly collect information from children. If a child has provided us with personal information, a parent or guardian of that child may contact us to request deletion of this information from our records. We collect information to provide you with our Services, to bill you, and to communicate with you, among other uses. We collect information from the following sources: Information you give usWhen you sign up for or purchase a Service from GFiber, you may provide us with certain personal information, including identifiers and commercial information such as your name, email address, home or service address, telephone number, bank account information, or credit or debit card information. In addition, when you contact us, we may keep a record of your communication. If you make a purchase from us, we may work with a third-party payment processor to process your payment information. Information we get from your use of our ServicesWe collect certain information when we install, configure, troubleshoot, or update your Services and when you otherwise use our Services. This information may include the following:- Identifiers and Device Information: We may collect device-specific information such as your hardware model, operating system version and unique device identifiers for your devices (e.g., your computer, network hardware, etc.). We may associate your device information with your account. We may also access and collect unique device identifiers and other technical information from or about computer and network hardware and software, modems, phone boxes, or other systems or devices used in connection with Services.
- Server Log Information: When you use the Services or view content provided by us, we may collect and store certain information in server logs. This includes Internet or other electronic network activity information (such as details of how you used our service), and identifiers such as your IP address, and cookies that may uniquely identify your browser.
- Phone Log Information: When you use GFiber Phone, we collect internet and electronic network activity information such as your call history (including calling party phone number, called party phone number, date, time and duration of call), voicemail greetings, voicemail messages, Short Message Service (SMS) messages, recorded conversations, and other data related to your account.
- Location Information: When you use the Services, we may collect and process precise and approximate geolocation information. We use various technologies to determine location, including identifiers such as IP address, GPS, and other sensors that may, for example, provide GFiber with information on nearby devices, Wi-Fi access points and cell towers.
- Local Storage: We may collect and store Internet or other electronic network activity information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data cache.
- Cookies and Similar Technologies: We and our affiliates and service providers use various technologies to collect and store information when you visit our websites, and this may include using identifiers such as cookies or similar technologies to identify your browser or device. We also use these technologies to collect and store Internet or other electronic network activity information when you interact with Services we offer to our business partners. As a Google-branded affiliate, we use Google Analytics, which helps businesses and site owners analyze the traffic to their websites and apps, and Google ads products and services to help market our Services. Google Analytics information is linked, by the Google Analytics customer or by Google, using Google technology, with information about visits to multiple sites.
How We Use Information We Collect
In general, we use the information we collect from all of our Services to provide, maintain, protect, troubleshoot, and improve the Services. We also use information about you for the following purposes:- to develop new Services;
- to protect our network and our users; to enforce our rights if we determine a violation of this Privacy Policy, the applicable Terms of Service, or other GFiber policy has occurred;
- to comply with laws; and to assist us in fraud prevention or investigation;
- to personalize your experience with us;
- to send you technical notices, security alerts, support messages, and other transactional or relationship messages;
- to send you marketing communications (see the Choices section below for information about how to opt out of these communications at any time);
- GFiber Internet: We use the information collected from the use of GFiber Internet for network management, security, maintenance or other related purposes outlined in our , or for legal reasons. Technical information (such as device identifiers, IP address and signal/speed test results) may be associated with your GFiber account (if applicable) but will not be used for any other purpose other than as described above without your consent. Other information from the use of GFiber Internet (such as URLs of websites visited or content of communications) will not be associated with your GFiber account, except with your consent or to meet any applicable law, regulation, legal process or enforceable governmental request.
- GFiber Phone: Our GFiber Phone Services are powered by Google Voice. All information we collect about your use of GFiber Phone may be associated with the Google Account being used for GFiber Phone. In addition to the business and commercial purposes listed in the , and the article How Google Voice works, we use this information for our business purposes, such as to provide your service, bill you for our Services, help you troubleshoot any issues you are experiencing, verify your identity, and protect you and us from fraud, phishing or other misconduct. As described below, some of your GFiber Phone information is treated as CPNI and used in accordance with federal law.
Choices
You may set your browser to block all cookies, including cookies associated with our Services, or to indicate when a cookie is being set by us. However, it’s important to remember that some of our Services may not function properly if your cookies are disabled.You can access, correct, and delete certain information stored within your account at any time through your customer portal. You may opt out of receiving text messages or promotional emails from GFiber by following the instructions in those communications. If you opt out, we may still send you non-promotional emails, such as those about your account.Customer Proprietary Network Information
We take our duty to protect your Customer Proprietary Network Information (“CPNI”) very seriously. Federal law requires certain voice and Internet access providers, including interconnected Voice over Internet Protocol service providers like GFiber Phone, to protect certain personal information that we generate or access in providing the Services to you. CPNI for voice Services includes, but is not limited to, call details, call location information, and information about the rates and features of the Services that you use. CPNI does not include customer list information, such as your name, address, or phone number. We may use the information we collect about your use of GFiber Phone to send you information about the Services in compliance with our obligations to protect your CPNI. Here are the ways we treat your CPNI associated with GFiber Phone:- Securing your CPNI. We implement safeguards that are designed to protect your CPNI. We authenticate you with a password or other permissible means before we disclose any CPNI.
- Using CPNI without your additional approval is limited to specific purposes. By using the GFiber Phone Services, you allow us to use, disclose, and permit access to your CPNI without your additional approval only for the following limited purposes:
- To provide and offer Services and features among the category of Services you’re purchasing from us. This includes using CPNI in the normal course of business, such as to enable billing, customer service, and troubleshooting.
- To protect our rights and property.
- To protect our users and other carriers from fraudulent, abusive, or unlawful uses of the Services.
- To comply with applicable laws and legal process. For any other purpose permitted by federal law.
Information We Disclose
We do not disclose your personal information with other companies, organizations and individuals outside of GFiber and its commonly-branded affiliates unless one of the business or commercial purpose below applies. Personal information collected through the SMS short code program will not be disclosed, sold or rented to third parties outside of GFiber and its service providers as set out in this Privacy Policy.With your consent or at your direction.We will disclose your personal information with other companies, organizations or individuals when we have your consent to do so. For example, your phone number may be displayed to the person you’ve called. You can find out how to block your phone number from being displayed .For external processing. We provide personal information to our trusted businesses or persons (including external service providers, such as payment processors) to process it for us, including for the uses described in the “How we use information we collect” section above, based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures. For legal reasons.We will disclose personal information to other companies, organizations, or individuals if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:- Meet any applicable law, regulation, legal process, or enforceable governmental request;
- Enforce applicable Terms of Service, including investigation of potential violations;
- Detect, prevent, or otherwise address fraud, security, or technical issues;
- Protect against harm to the rights, property or safety of GFiber, our users, or the public as required or permitted by law; or
- If GFiber is involved in any merger, acquisition, sale of company assets, transition of service to another provider, or insolvency, bankruptcy or receivership, we reserve the right to transfer your personal information in connection with such transaction. In such instances, we will strive to ensure your personal information continues to be treated in accordance with this Privacy Policy; otherwise, we will notify you and obtain your consent before your personal information becomes subject to a different privacy policy that is not materially consistent with this one.
Data Retention
We store personal information for as long as necessary to carry out the purposes for which we originally collected it and for other business purposes explained in this Privacy Policy. Retention periods vary by data type, for example:We keep data required to provide our Services until it is no longer needed to provide our Services, such as customer account information like your name, contact information, and plan information. Your settings may be stored locally on GFiber-owned equipment. Equipment is reflashed upon return, which results in deletion of your settings.We retain some data for longer periods of time when necessary for legitimate business or legal purposes, such as security, fraud and abuse prevention, tax, or financial record-keeping.U.S. State Privacy Law Requirements
Some U.S. state privacy laws, like the California Consumer Privacy Act or “CCPA,” require specific disclosures for state residents (“U.S. State Privacy Laws”). If you reside in one of these states, this section applies to you. This section also serves as our California notice at collection.Subject to certain limitations, U.S. State Privacy Laws provide rights to consumers to have notice about the collection, use, and disclosure of their personal information, request access to their personal information (including how we use and disclose that information), sometimes in a portable format, request correction of inaccurate personal information, request deletion of their personal information, request to opt out of the “sale”, “sharing”, or “targeted advertising” of personal information (where applicable), request to limit use of sensitive personal information (where applicable), and to not be discriminated against for exercising their rights.GFiber does not “sell” or “share” your personal information. The online form details the pieces of information needed to verify your identity. If an authorized agent submits a request on your behalf, we may confirm the request and your identity directly with you unless the agent demonstrates they have a power of attorney. Please do not provide any sensitive personal information in connection with this request, such as a driver's license or other government-issued ID. If you have any questions or concerns regarding our practices, please contact us by clicking if you are a GFiber customer and clicking if you are GFiber Webpass customer. If we deny your request, you may appeal our decision by contacting us. If you have concerns about the results of an appeal, you may contact the attorney general in the state where you reside. Certain U.S. State Privacy Laws require a description of data practices in the preceding 12 months using specific categories. This table uses these categories to organize the information in this Privacy Policy. We collect this information from the following sources: information you provide, information we collect automatically through use of the Services, and information we get from other sources. Use of service providers: GFiber discloses information with service providers to perform services on our behalf, in compliance with our Privacy Policy and other appropriate confidentiality and security measures. For example, we may rely on service providers to help provide customer support. Marketing: GFiber uses information to market our Services.
